Shared Governance

Representational Problems/Issues with Shared Governance, Nurse Practice, or Other Committees
 
Committee participants should always be aware of, and respond to, any interference with union representation of individual rights and/or interference with collective bargaining rights of JNESO members.
 
The major labor/legal issues of concern include: 
  1. Just Cause Standard- if signing a waiver regarding behavior and expectations, members may be waiving their right to due process and grievance; 
  2. Teams- teams may attempt to set standards, create compliance measurements or discuss contract issues.  This may constitute direct dealing if teams discuss any condition of employment [such as scheduling, staffing, patient satisfaction, rewards, or other items which need to be negotiated]; 
  3. Scripting- many initiatives establish scripting to establish behavioral standards, but evaluating behavior and attitude may be subjective.  Sometimes scripting attempts to inform patients that RNs have lots of time.  This may violate the RNs right and obligation to use professional judgment in assessing whether they have sufficient staff/resources to provide excellent care [May conflict with information on a short staffing form].
If you are a Shared Governance, Nurse Practice, or other committee participant, it is imperative that you be alert for any discussions that may interfere with  RN’s legal rights.
 
If a Mandatory Subject of Bargaining is being discussed….OBJECT!!
Tell your manager any further dialog may be unlawful & MUST BE BARGAINED with JNESO!!
 
Please bring any possible violations such as improper council formation or discussion of contract issues to JNESO’s attention ASAP!!!
 
Mandatory subjects of bargaining are issues of wages, hours and working conditions, these include:

  • Employer rules
  • Wages/ Salaries
